Acceptance of Terms
By using ZyAI at zyai.org, you agree to these Terms. If you disagree, do not use the Service. Continued use after changes constitutes acceptance of updated Terms.
Description of Service
ZyAI is an AI-powered platform providing conversational assistance, knowledge search, file analysis, developer API access, and DeFi data tools, running on Cloudflare Workers with third-party AI providers (Google Gemini, Groq, OpenRouter, Mistral AI, HuggingFace).
Important: AI outputs are for informational purposes only and do not constitute legal, medical, financial, or professional advice.
Eligibility
You must be at least 13 years old (under 18 requires parental consent), have legal capacity to enter a binding agreement, and not be prohibited by applicable law or sanctions.
Account Registration & Security
Provide accurate information, keep credentials secure, and accept responsibility for all account activity. Report unauthorized access to contact@zyai.org immediately.
Account sharing is strictly prohibited. Each account is for one individual only. Violations result in immediate suspension without refund.
Acceptable Use
You may use ZyAI for lawful personal, educational, or professional purposes. You are solely responsible for how you use AI outputs. ZyAI outputs are not professional advice of any kind.
Prohibited Activities
You may not use ZyAI to generate illegal content, create malware, harass or threaten others, generate content sexualizing minors (zero tolerance — immediate ban and law enforcement report), circumvent security measures, scrape the platform, impersonate others, train competing AI models without consent, spread disinformation at scale, or disrupt the Service.
Violations may result in immediate termination, law enforcement reporting, and legal action.
API Access & Developer Terms
- 3-day waiting period: New free accounts must be 3+ days old before generating an API key. Paid subscribers are exempt.
- Key security: Keep your API key confidential. Never expose it in public code or client-side applications.
- Rate limits: Free accounts have usage limits. Circumventing them is prohibited.
- Revocation: We may revoke API keys at any time for violations, without notice or liability.
ZyAI is not liable for damages caused by applications built on the API.
Subscriptions & Payments
- Payment: Via cryptocurrency on supported networks, verified by on-chain transaction hash.
- No refunds: All payments are final unless required by law. Contact contact@zyai.org within 48 hours for payment errors.
- Fraud: Submitting a false transaction hash is fraud and results in immediate termination and possible law enforcement report.
Intellectual Property
ZyAI branding, design, and code are owned by or licensed to ZyAI. You retain ownership of content you submit and grant ZyAI a limited license to process it solely to provide the Service. AI outputs are produced by third-party models; ZyAI makes no ownership claim over them. You are responsible for verifying their accuracy.
AI Training Data & Your Consent
ZyAI is building its own AI model. With your consent, anonymized conversation data may be used for training.
Your choice is respected. Participation is opt-in by default. Change anytime from Settings → Capabilities → Data & Privacy. Takes effect immediately.
Never used for training: uploaded files, opted-out accounts, guest sessions, payment data or credentials.
You may request deletion of your training data at any time: privacy@zyai.org. Processed within 30 days (GDPR Art. 17, CCPA).
Disclaimers & Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. AI RESPONSES MAY BE INACCURATE. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE ACCESS.
We are not liable for: damages from use or inability to use the Service; decisions made based on AI output; third-party AI provider failures; unauthorized access where you failed to secure credentials.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) AMOUNTS YOU PAID IN THE PRIOR 12 MONTHS, OR (B) USD $100.
Nothing in these Terms limits liability for gross negligence, willful misconduct, fraud, or death/personal injury caused by negligence. Some jurisdictions do not allow certain liability exclusions; in such cases our liability is limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify ZyAI from any claims, damages, and legal fees arising from your violation of these Terms, your use of the Service, your violation of third-party rights, or harm caused by your content. This obligation survives termination.
Termination
We may suspend or terminate your account at any time for violations, fraud, or business reasons. Upon termination: access ends immediately; you may request a data export within 30 days at contact@zyai.org; after 30 days data may be permanently deleted. Sections 9, 10, 11, 12, and 14 survive termination.
Data retention: Account data is retained for 30 days after termination, then permanently deleted. Conversation history may be retained in anonymized, aggregated form for up to 12 months for service improvement, unless you opt out via privacy@zyai.org. Under GDPR Art. 17 and CCPA, you may request immediate deletion at any time.
Governing Law & Disputes
Disputes shall first be resolved through 30-day good-faith negotiation, then binding individual arbitration. You waive any right to class action. Either party may seek emergency injunctive relief for IP violations. If any provision is unenforceable, remaining provisions stay in effect.
Changes to Terms
We may update these Terms at any time. Material changes will be noted by updating the date above and, where required by law, by email to registered users. Continued use constitutes acceptance.
